TRANSFERS BY THE BOAT AGAPÉ
 
 
 
Terms of Business for transfers to and from Sanda Island
 
Passengers, luggage and goods shall be carried by the Company under these Conditions:
Transfer to Sanda Island is by the rigid inflatable boat, “Agapé”, which is coded to the relevant standard for passenger transport.
The weather and tides around the Mull of Kinytre can on occasion make for a bracing journey to Sanda Island so when using our transport guests must wear a lifevest.   Guest must advise at the point of booking if they have any particular health problems which might be an issue during the journey.
Guests must only embark or disembark from the piers at Campbeltown and Sanda Island when the boat is safely moored and the boat driver instructs that it is safe to do so. The pier at Sanda Island was built in 1857 and because of the nature of its construction and the tides can be very slippery. Guests should therefore take care when embarking and disembarking and walking on the pier.
The Company shall be entitled to refuse to carry any passenger and/or their luggage or goods if there are reasonable circumstances in which to do so.  Although the Company will make every reasonable effort to carry passengers and/or their luggage in a particular vessel on a particular day and at an agreed time, the Company does not guarantee that it will do so if unforeseen circumstances arise.  In the event of delay to, or cancellation of, a sailing, Sanda Island Limited does not accept any liability for any losses, costs, or expenses incurred by passengers.  Passengers are advised to consider purchasing travel cancellation/delay insurance.
Sanda Island Limited regrets that it cannot accept liability or pay any compensation where a journey is prevented or affected by or you otherwise suffer any damage or loss as a result of “force majeure”.  “Force majeure” is defined as any event which we could not, even with all due care, foresee or avoid.  Such events may include, but are not limited to, war or threat of war, riot, civil strife, terrorist activity or actual threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.
Passengers shall be liable to Sanda Island Limited for any damage or loss caused by them or any member of your party. 
These terms are governed by and to be interpreted in accordance with Scottish law and are subject to the exclusive jurisdiction of the Scottish Courts.
